The manufacturing industry faces a trend in which employees’ work processes are being redesigned into simple, repetitive tasks that maximize performance and efficiency. This neo-Tayloristic business model reduces social interactions and stifles relationship building, leading to disgruntled employees and raising questions about leaders’ moral obligation as to the mechanisms they use to enhance employees’ performance at work. As an alternative to redesigning work processes, we contend that servant leaders can enhance employees’ overall performance by cultivating positive interpersonal dynamics at work (...) where social connectedness flourishes. Integrating insights from self-determination theory with servant leadership’s moral foundations, we investigate the degree to which servant leadership fosters two elements of a relationally supportive social context, interactional justice climate and coworker support, that facilitate its influence on followers’ intrinsic motivation and, subsequently, their voice and in-role performance. Temporally-separated data collected from a sample of 296 employees and their supervisors situated in 44 teams yielded results that support our hypotheses. Results underscore the importance of servant leadership cultivating a positive relational context to increase employees’ intrinsic motivation and improve their behaviors at work. (shrink)

I propose a taxonomy of arguments for the existence of God and survey those categories of arguments I identify as nontraditional. I conclude with two general observations about theistic arguments, followed by suggestions for going forward.

The purpose of this research is to examine the effect of two organizational variables, budget goal difficulty and promotion availability, on employee fraud. Limited research shows that difficult, specific goals result in more unethical behavior than general goals :422–432, 2004). We predict that goal difficulty and promotion availability will interact to affect employee fraud. Specifically, we contend that the availability of promotions will have little, if any, effect on employee fraud under easy goals but have a substantial effect on fraud (...) under extremely difficult goals. To test this prediction, we use an experiment in which participants play the role of production employees. All participants are assigned cost goals and are responsible for reporting costs to the organization. Information asymmetry exists such that the organization is unable to assess whether costs have been reported accurately, and any overstatement of costs directly increases the employee’s compensation at the expense of the organization. The results of our experiment support the prediction, even though the cost goal is not tied to current period compensation. Our results have implications for academics and practitioners concerned with factors that affect fraud in organizations. (shrink)

We present the findings of a worldwide survey that was administered to business ethic scholars to better understand journal quality within the business ethics academic community. Based upon the data from the survey, we provide a ranking of the top 10 business ethics journals. We then provide a comparison of business ethics journals to other mainstream management journals in terms of journal quality. The results of the study suggest that, within the business ethics academic community, many scholars prefer to publish (...) in the top business ethics academic journals over other mainstream management journals. Furthermore, the results of the study suggest that within the business ethics academic field there are two dominant academic communities: one in Europe and one in North America. Each of these academic communities has its own preferred publication outlets, suggesting a potentially problematic bifurcation of business ethics scholarship. (shrink)

Purpose: to characterize ethics course content, structure, resources, pedagogic methods, and opinions among academic administrators and course directors at U.S. medical schools. Method: An online questionnaire addressed to academic deans and ethics course directors identified by medical school websites was emailed to 157 Association of American Medical Colleges member medical schools in two successive waves in early 2022. Descriptive statistics were utilized to summarize responses. Results: Representatives from 61 (39%) schools responded. Thirty-two (52%) respondents were course directors; 26 (43%) were (...) deans of academic affairs, medical education, or curriculum; and 3 with other roles also completed the survey (5%). All 61 schools reported some form of formal ethics education during the first year of medical school, with most (n = 54, 89%) reporting a formal mandatory introductory course during preclinical education. Schools primarily utilized lecture and small-group teaching methods. Knowledge-based examinations, attendance, and participation were most commonly used for assessment. A large majority regarded ethics as equally or more important than other foundational courses, but fewer (n = 37, 60%) provided faculty training for teaching ethics. Conclusions: Despite a response rate of 39 percent, the authors conclude that medical schools include ethics in their curricula in small-group and lecture formats with heterogeneity regarding content taught. Preclinical curricular redesigns must innovate and implement best practices for ensuring sound delivery of ethics content in future curricula. This ambitious book presents a new interpretation of Chinese thought guided both by a philosopher's sense of mystery and by a sound philosophical theory of meaning. That dual goal, Hansen argues, requires a unified translation theory. It must provide a single coherent account of the issues that motivated both the recently untangled Chinese linguistic analysis and the familiar moral-political disputes. Hansen's unified approach uncovers a philosophical sophistication in Daoism that traditional accounts have overlooked. The Daoist theory treats the imperious intuitionism (...) that alienates critical thinkers as a feature of Confucianism alone. Freed from the view that Confucianism is the core of Chinese thought and from myopic Confucian interpretations, Chinese thinkers emerge as unmistakably philosophical. (shrink)

The special composition question is the question, ‘When do some things compose something?’ The answers to this question in the literature have largely been at odds with common sense, either by allowing that any two things compose something, or by denying the existence of most ordinary composite objects. I propose a new ‘series-style’ answer to the special composition question that accords much more closely with common sense, and I defend this answer from van Inwagen's objections. Specifically, I will argue that (...) the proposed answer entails the transitivity of parthood, that it is non-circular, and that it casts some light on the ancient puzzle about the Ship of Theseus. In this paper, I will examine an argument for fatalism. I will offer a formalized version of the argument and analyze one of the argument’s most controversial assumptions. Then, I will argue that one ought to reject the assumption that propositions about the future are true facts of the past, even if no one makes reference to such propositions.

Documentarians certainly have different ethical standards than their journalist counterparts, yet filmmakers also adhere to ethical constructs such as truth telling and privacy. The decision by Morgan Neville to recreate Bourdain’s voice in Roadrunner, and ethical issues including truth telling and privacy that the decision created, are not outweighed by the news value or impact of that inclusion.

As Mexico endures the far-reaching economic and social dislocations wrought by neoliberalism, many predominantly rural states in southern Mexico have witnessed an unprecedented northward exodus of working age men and women. This article argues that in response to these intense pressures to emigrate, poor men from rural Mexico do more than make instrumental calculations about migration to the border; they must negotiate masculine ideals and adopt strategic gendered practices in relation to the migration experience and the dynamic economic, social and (...) cultural conditions of the border region. This article finds that men adopt one or a hybrid of three fluid masculine stances—traditionalist, adventurer, and breadwinner—in response to migration pressures in neoliberal Mexico. (shrink)

We agree that promoting intergroup harmony system-justifying and identify several ways in which and stereotypes, superordinate identification, intergroup contact, and prejudice reduction techniques can undermine social change motivation by reinforcing system-justifying beliefs. This may but it also prevents individuals and groups from tackling serious social problems, including inequality and oppression.

Ostension is bodily movement that manifests our engagement with things, whether we wish it to or not. Gestures, glances, facial expressions: all betray our interest in something. Ostension enables our first word learning, providing infants with a prelinguistic way to grasp the meaning of words. Ostension is philosophically puzzling; it cuts across domains seemingly unbridgeable -- public--private, inner--outer, mind--body. In this book, Chad Engelland offers a philosophical investigation of ostension and its role in word learning by infants. Engelland discusses (...) ostension (distinguishing it from ostensive definition) in contemporary philosophy, examining accounts by Quine, Davidson, and Gadamer, and he explores relevant empirical findings in psychology, evolutionary anthropology, and neuroscience. He offers original studies of four representative historical thinkers whose work enriches the understanding of ostension: Wittgenstein, Merleau-Ponty, Augustine, and Aristotle. And, building on these philosophical and empirical foundations, Engelland offers a meticulous analysis of the philosophical issues raised by ostension. He examines the phenomenological problem of whether embodied intentions are manifest or inferred; the problem of what concept of mind allows ostensive cues to be intersubjectively available; the epistemological problem of how ostensive cues, notoriously ambiguous, can be correctly understood; and the metaphysical problem of the ultimate status of the key terms in his argument: animate movement, language, and mind. The ancient puzzle of Dion and Theon has given rise to a surprising array of apparently implausible views. For example, in order to solve the puzzle, several philosophers have been led to deny the existence of their own feet, others have denied that objects can gain and lose parts, and large numbers of philosophers have embraced the thesis that distinct objects can occupy the same space, having all their material parts in common. In this paper, I argue for an alternative (...) approach: I claim that human beings have ordinary parts—hands, heads, feet, and so on—but no extraordinary parts, such as ‘foot-complements’, the existence of which is essential to the puzzle. I rebut three objections to this approach: an objection that it is unacceptably metaphysically arbitrary, an objection that the view is incompatible with versions of the puzzle involving decapitation, and an objection concerning masses of matter. If we can believe that there are such things as hands and feet without involving ourselves in paradox, and without accepting large numbers of co-located material objects that share all their material parts, then that is what we should do. I will argue that internalism about justification entails the apparently absurd conclusion that it is possible to know specific facts about the external world—for example, that there is a tree in the quad—on the basis of introspection and a priori reflection. After a brief characterization of internalism (§1), I will set out the problem (§2). I will then discuss three replies: one that denies the form of doxastic voluntarism involved in the problem (§3), one that denies that knowledge of higher-order (...) facts about justification can justify corresponding first-order beliefs (§4), and, finally, one that involves biting the bullet (§5). This paper will begin with an explication of the central tenets of Nussbaum’s capabilities theory. The next section examines Nussbaum’s two-fold justification of capabilities; namely, the substantive good approach (or intuitionism), which serves as the primary justification, and a version of Kantian proceduralism, which provides ancillary support. The following section focuses on Jaggar’s critique of Nussbaum. Here, I will discuss three criteria of adequacy for a global ethic and their importance, why we should accept them and how both of Nussbaum’s (...) justification strategies fail to satisfy them. In the fifth section, I propose a version of discourse ethics as an alternative justification for capabilities that can satisfy the adequacy discerned from Jaggar’s critique. This account of discourse ethics reveals that intersubjective dialogue under certain conditions is more likely to provide adequate justification of capabilities, and those engaged in dialogue are also likely to develop practical reason and affiliation. So this method of justification does not merely ground the capabilities, but helps people realize them. Finally, the sixth section presents an example from the Self-Employed Women’s Association as a real-life case illustrating how this version of discourse ethics can be manifested. (shrink)

Our view is that the folk concept of knowing how is more complicated than many epistemologists assume. We present four studies that go some way towards supporting our view—that the folk concept of knowledge-how is a philosophical hybrid, comprising both intellectualist and anti-intellectualist features. One upshot is, if we are going to award a presumptive status to philosophical theories of know-how that best accord with the folk concept, it ought to go to those that combine intellectualist and anti-intellectualist elements.

I argue that a nominalistic interpretation utilizing the notion of "stuffs" (mass objects) is a more plausible explanation of the dialogue. It is more coherent internally, More consistent with kung-Sun lung's other dialogues, And the tradition of chinese thought which is usually regarded as nominalistic. Starting from an account of the ontological, epistemological, and physiological foundations of the tripartition of the soul, he traces the increasing sophistication of Plato's thinking about the nature of pleasure and pain and his developing interest in sciences bearing on physical (...) reality. These theoretical shifts represent a movement away from a conception of human happiness as a purification or flight of the soul from the sensible to the intelligible, as in the Phaedo, towards a focus on the harmony of the individual as a psychosomatic whole under the hegemonic power of reason. Abstract:This essay performs an anticolonial and poetic methodology of combining Black and Native feminists' deconstruction of metaphor and metaphysics in order to argue for the centrality of colonial metaphor to colonial metaphysics. I combine their analyses of the separate gendered metaphors of Blackness and Indianness and the centrality of these metaphors to the development of a global metaphysics as well as the transference of the terms of metaphysics to whiteness. I then apply this method of combined terms and readings to (...) white colonial writing that compares Black and Native America, which transforms both communities not only into individually potent, gendered metaphors but into an essential poetic pairing, a poetic couplet. Drawing on the work of Black and Native feminists, I further argue that when we take this paired model to evaluate the political concerns of Black and Native America, we come to a more complete and global understanding and refutation of whiteness. The creation, connection, and comparison of the gendered metaphors and archetypical figures of the "African Slave" and "Indian Savage" are important to each other and to the creation of a Western conception of the globe. Colonialism uses gender to compound metaphor's ability to create, by combining metaphors of gender with metaphors of race and colonialism to develop new symbolic amalgamations. This gestalt of metaphors comes together in order to create a fictive European metaphysics used to ameliorate white fears of the diversity of life on planet Earth and to satisfy white desires to control it. In this coupled metaphoric form, Blackness and Indianness are not connected by analogy but by the open-ended cut, the caesura, of poetry and the violence of slavery and conquest. I offer this anticolonial and poetic pairing as a model for political imagining between Black and Native theory. (shrink)

In his book Das Recht der Freiheit, Axel Honneth develops a theory of social justice that incorporates negative, reflexive and social forms of freedom as well as the institutional conditions necessary for their reproduction. This account enables the identification of social pathologies or systemic normative deficits that frustrate individual efforts to relate their actions reflexively to a normative order and inhibits their ability to recognize the freedom of others as a condition of their own. In this article I utilize Honneth’s (...) theory in the diagnosis of a contemporary social pathology, which impedes social recognition and thereby contributes to social injustice. I argue that this particular social pathology – associated with the Second Amendment right to bear arms – has given rise to a pernicious form of subjectivity, which I call self-defensive. I conclude with some remarks concerning what this application reveals about the strengths and weaknesses of Honneth’s account. (shrink)

According to the traditional bundle theory, particulars are bundles of compresent universals. I think we should reject the bundle theory for a variety of reasons. But I will argue for the thesis at the core of the bundle theory: that all the facts about particulars are grounded in facts about universals. I begin by showing how to meet the main objection to this thesis (which is also the main objection to the bundle theory): that it is inconsistent with the possibility (...) of distinct qualitative indiscernibles. Here, the key idea appeals to a non-standard theory of haecceities as non-well-founded properties of a certain sort. I will then defend this theory from a number of objections, and finally argue that we should accept it on the basis of considerations of parsimony about the fundamental. (shrink)

The paper presents an approach for developing multi-agent reinforcement learning systems that are made up of a coalition of modular agents. We focus on learning to segment sequences (sequential decision tasks) to create modular structures, through a bidding process that is based on reinforcements received during task execution. The approach segments sequences (and divides them up among agents) to facilitate the learning of the overall task. Notably, our approach does not rely on a priori knowledge or a priori structures. Initial (...) experiments demonstrated the basic promise of the approach. This work shows how bidding and reinforcement learning can be usefully combined, thus pointing to a new research direction. This paper is concerned with autonomous learning of plans in probabilistic domains without a priori domain-specific knowledge. In contrast to existing reinforcement learning algorithms that generate only reactive plans and existing probabilistic planning algorithms that require a substantial amount of a priori knowledge in order to plan, a two-stage bottom-up process is devised, in which first reinforcement learning/dynamic programming is applied, without the use of a priori domain-specific knowledge, to acquire a reactive plan and then explicit plans are extracted from (...) the reactive plan. Several options for plan extraction are examined, each of which is based on a beam search that performs temporal projection in a restricted fashion, guided by the value functions resulting from reinforcement learning/dynamic programming. Some completeness and soundness results are given. Examples in several domains are discussed that together demonstrate the working of the proposed model. (shrink)

In this paper, I develop a theory on which each of a thing’s abundant properties is immanent in that thing. On the version of the theory I will propose, universals are abundant, each instantiated universal is immanent, and each uninstantiated universal is such that it could have been instantiated, in which case it would have been immanent. After setting out the theory, I will defend it from David Lewis’s argument that such a combination of immanence and abundance is absurd. I (...) will then advocate the theory on the grounds that it accomplishes all of Lewis’s “new work” while providing a gain in parsimony and a new account of fine-grained content. I will close with a discussion of how the theory also affords a new reply to two objections to uninstantiated universals: Armstrong’s charge that they are inconsistent with naturalism, and a Benacerraf-Field-style objection about epistemic access. Zhuangzi and Hui Shi's discussion about whether Zhuangzi knows 'fish's happiness' is a Daoist staple. The interpretations, however, portray it as humorous miscommunication between a mystic and a logician. I argue for a fine inferential analysis that explains the argument in a way that informs Zhuangzi philosophical lament at Hui Shi's passing. It also reverses the dominant image of the two thinkers. Zhuangzi emerges as the superior dialectician, the clearer, more analytic epistemologist. Hui Shi's arguments betray his tendency (manifest elsewhere) (...) to misstate the conclusions of their shared relativism leading him but not Zhuangzi to intuitive mysticism. (shrink)

In The Felt Meanings of the World, Quentin Smith lays the groundwork for a metaphysical worldview that is meant to stand as an alternative to nihilism. Smith finds fault with nihilism inasmuch as it fails to account for the possibility that faculties other than reason, namely feelings or intuition, may be the source of important metaphysical insight. From this observation, Smith builds his “metaphysics of feeling,” which is not concemed with rational explanations of the world’s existence, but rather with the (...) relationship between the world and our own feelings. This information, Smith says, can satisfy our metaphysical longings inasmuch as we can become more aware of “what” the world is, even if we can never know “why” it exists. Smith’s metaphysic is a viable one, but it is not without its problems. Most notable of these is Smith’s conclusion that “joy” is the proper affective response to the pure existence of the world, or Being simpliciter. It is my intent to show not only that joy cannot be an affective response to Being simpliciter; but also that the metaphysics of feeling renders incoherent any notion of affective response to Being simpliciter. This study attempts to determine a correlation effect between people’s perception and awareness of the operationalization of artificial intelligence in their everyday lives and in the production, presentation, and publication of news media in the U.S. By looking at the effect individual characteristics may have on a person’s perception and awareness of AI operationalized for news media and looking at whether perception and/or awareness of AI operationalized in a person’s daily life affects their perception and awareness of AI operationalized for (...) news media, we seek to find correlation between these two factors. The research relies on Actor-network theory, the MAIN Model, and utilizes a convenience sample survey method using the MTurk participant platform. (shrink)

It is argued that core areas of philosophy can benefit from reflection on cross-disciplinary research (CDR). We start by giving a brief account of CDR, describing its variability and some of the ways in which philosophers can interact with it. We then provide an argument in principle for the conclusion that CDR is philosophically fecund, arguing that since CDR highlights fundamental differences among disciplinary research worldviews, it can be used to motivate new philosophical problems and supply new insights into old (...) problems. We close by providing an argument by example that uses the epistemology of peer disagreement to establish the potential of CDR for core philosophical areas. With this argument, we aim to demonstrate how the complex research contexts that CDR affords can point the way toward important avenues of epistemological research by highlighting potential limitations of key epistemological components, such as peerage and uniqueness. Confucian moral philosophy doesn't seem to provide a theory of excuses. I explore an explanatory hypothesis to explain how excuse conditions might be built into the Confucian doctrine of rectifying names. In the process, I address the issue of the motivation for the theory. The hypothesis is that the theory provides not only excuse conditions, but also exception and conflict resolution roles for an essentially positive morality rooted in the traditional code of 禮 li/ritual, transmitted from the ancient sage kings. Upon arriving at his Paris hotel, Russell found a letter from Einstein agreeing to sign Russell’s statement. In his autobiography, Russell reports: “This was one of the last acts of his [Einstein’s] public life.” Joseph Rotblat (1908–2005)1 met Russell in 1954 at a dinner-discussion given by the bbc on the results of the Bikini test and the future of nuclear weapons. Rotblat went on to become an adviser to Russell on the details of nuclear weapon science and was subsequently recruited by the latter to sign the same document Einstein had. Rotblat chaired the press conference on 9 July 1955 at Caxton Hall in London, presenting the world with what became known as the Russell– Einstein Manifesto. Rotblat was the Manifesto’s youngest and, until his death in 2005, the last surviving signatory. Although Rotblat was not a Nobel Laureate, Russell predicted, correctly, that he would eventually become one. In reference to Rotblat and his activities, Russell remarked: He can have few rivals in the courage and integrity and complete self-abnegation with which he has given up his own career (in which, however, he still remains eminent) to devote himself to combatting the nuclear peril as well as other, allied evils. If ever these evils are eradicated and international aTairs are straightened out, his name should stand very high indeed among the heroes. (Auto. 3: 77–8) Joseph Rotblat: Visionary for Peace is a compilation of tributes to the late Joseph Rotblat published by Wiley-vch. It features no less than 45 contributors. The volume is a celebration of one of the truly great activists for nuclear disarmament. It also features as an 84-page appendix eight of his most historic writings. There is also a new photograph of Russell (p. 89). As justly famous as Rotblat is for his eTorts to prevent nuclear war, though, his distinction in this arena tends to eclipse his other impressive achievements, most notably those in nuclear and medical physics. Joseph Rotblat: Visionary for Peace is valuable for the attention it draws to both the more and less famous aspects of his legacy. In the present reviewer’s opinion, the book’s reminiscences have some unnecessary overlap and the editors could perhaps have more strongly encouraged each contributor to further develop instead the distinctivez things they had to say about Rotblat. Somewhat less forgivable, considering the rich details of Rotblat’s life, is the book’s lack of an index. A Polish Jew, Rotblat earned his doctorate in physics from the University of Warsaw. He was one of three coauthors of its lengthy entry on Bertrand Russell. In (...) 1957, Edwards also edited Bertrand Russell’s Why I Am Not a Christian. A collection of his writings entitled God and the Philosophersz has been recently published, edited by Tim Madigan. Timothy Madigan is a previous editor of Free Inquiry who would visit Ed­ wards when travelling to New York City and who had the privilege over the years of reading several drafts of God and the Philosophers, which Edwards knew would be his Wnal project (p. 8). Madigan explains: “Never one to hide his own unbelief, Edwards often com­ mented that his two main goals were to demolish the inXuence of Heidegger and keep alive the memory of William Reich, the much-reviled psychoanalyst whose critiques of religion Edwards felt still remained valid” (p. 10). God and the Philosophersz is probably best appreciated as a very readable survey that is basically a patchwork of Edwards’ various musings on some of the West’s more iconoclastic philosophers. The work is not a systematic compendium and is probably of most value to those inclined to free thought and making their ini­ tial forays into the history of philosophy. The order in which Edwards discusses the thinkers is chronological, but his method of selection is idiosyncratic, especially in the earlier chapters. It is un­ clear why medieval Wgures like Maimonides and Aquinas are includedz in this col­ lection and great ancient independent thinkers like Xenophanes of Colophon and Strato of Lampsacus are excludedz. In any case, Edwards nowhere explains his criteria, or method, for selecting the thinkers he discusses. Edwards credits Russell with being “probably the most inXuential unbeliever of the twentieth century” (p. 253). And the personal inXuence of Russell on Ed­ wards is clear from Edwards’ mention that, while he himself was already “mov­ ing in the direction of unbeliefz”, reading three of Russell’s critiques of religion “Wxed me for good” (p. 253). Ed­ wards takes both Schopenhauer (p. 179) and Spencer (p. 242) to task for assum­ ing that something has no value if it is not permanent and, on both occasions, credits Russell with having a superior rival view. The one occasion where Russell evidently stuns Edwards as being more in the camp of the believers rather than the non-believers is Russell’s discussion of Spinoza’s equation of a mind conceiving something “under a form” of eternity with that mind being eternal. As Edwards sees it, Russell was “apparently under such a spell of Spinoza that he [Russell] reports this view without one word of dissent. My own dissent is very simple: if consciousness cannot exist without the body, no part of it can survive and be Wlled with ‘eternal thoughts’ of God or Nature or anything else” (p. 37). Perhaps Edwards’ most poignant invocation of Russell is at the close of the chapter on Nietzsche. This dissertation attempts to preserve the central tenets of a global moral theory called “the capabilities approach” as defended by Martha Nussbaum, but to do so in a way that better realizes its own goals of identifying gender injustices and gaining cross-cultural support by providing an alternative defense of it. Capabilities assess an individual’s well-being based on what she is able to do (actions) and who she is able to be (states of existence). Nussbaum grounds her theory in the intuitive (...) idea that each and every person is worthy of equal respect and dignity. The problem with grounding a theory in a version of intuitionism is that it runs the risk of authoritarian moral reasoning. I argue Nussbaum, in fact, is the final arbiter who decides which intuitions are mistaken, which are not, and how to interpret what people say to fit into her own framework. This method of justifying capabilities is most problematic in cases of social inequality whereby dominant group members do not feel they need to check their intuitions against non-dominant group members, and even if they did, they are not forced to take the non-dominant group’s intuitions seriously. I find capabilities as a global moral theory to be very promising, and I agree with Nussbaum that a list of capabilities is beneficial for identifying people who are not able to live a truly dignified human life. However, I am also sympathetic to the criticism of defending capabilities using a version of intuitionism. So, I offer an alternative method of justifying the capabilities rooted in the discourse ethics tradition. This method seeks all persons that are affected by the outcome to freely and equally share their opinion. This avoids the charge of authoritarian moral reasoning, because (1) it seeks perspectives other than simply one’s own, but unlike traditional ethics, it (2) pays special attention to the ways in which power relations shape dialogue. Ultimately, I hope to have preserved the central tenets of the capabilities approach while better realizing Nussbaum’s commitment to defending a theory that is gender sensitive and has gained cross-cultural support. Modern analytical political philosophy—characterized most notably by the work of John Rawls—has had very little to say about how punishment in particular and criminal law more generally might be justified. This is a puzzling omission, as punishment can be seen as the most serious use of coercive state power and therefore the one in greatest need of philosophical justification. With the idea of filling this gap, this chapter analyzes several major political theories of recent decades and examines how criminal justice (...) might fit into their thought. After discussing the various political theories of libertarianism, liberalism, communitarianism, Marxism, and republicanism, I offer a limited defense of one such theory, Rawls’s “political liberalism,” as offering a suitable way to approach issues of criminal justice and punishment in modern society. More broadly, my chapter invites political philosophers to speak more often and more specifically about how criminal justice fits within their theories. (shrink)

I have not taken many opportunities in my career to write about Zen Buddhism and Daoism, although I have been fascinated by their connection. I remember quite clearly a discussion I had with Jay some years back in which I broached the idea that Daoism had contributed important dialectical steps leading to the formulation of (...) Zen, which I join the Chinese tradition in regarding as the highest version of the Buddhist insight. Jay argued to me at that time that the necessary insights were actually all available in Nāgārjuna. I am accordingly pleased to see him .. (shrink)

This paper provides a qualified defense of Martin Heidegger’s controversial assertion that humans and animals differ in kind, not just degree. He has good reasons to defend the human difference, and his thesis is compatible with the evolution of humans from other animals. He argues that the human environment is the world of meaning and truth, an environment which peculiarly makes possible truthful activities such as biology. But the ability to be open to truth cannot be a feature of human (...) biology, without making such pursuits as biology, mathematics, and philosophy a biological function of a certain species, homo sapiens. To deny the human difference amounts to species relativism which leaves the normativity of truth unexplained. To reconcile the human evolutionary heritage and the uniquely human openness to meaning and truth, the paper amplifies a distinction occasionally made by Heidegger between condition and cause.
